Summary of the Preliminary Injunction
The court has issued a preliminary injunction in favor of WPEngine, restraining and enjoining the defendants, along with their officers, agents, employees, and others in active participation with them, from engaging in the following actions:
Access Interference: Blocking, disabling, or interfering with WPEngine’s and its related entities’ access to wordpress.org.
Plugin Interference: Interfering with WPEngine’s control over plugins/extensions hosted on wordpress.org that were developed, published, or maintained by WPEngine as of September 20, 2024.
WordPress Installations Interference: Using auto-migrate or auto-update commands to delete, overwrite, disable, or modify any WPEngine plugin without explicit consent from WPEngine or its users/customers.The injunction does not prevent wordpress.org from ensuring its security and operability in accordance with its policies as of September 20, 2024.
Defendants’ Obligations Within 72 Hours
The defendants are required to perform the following actions within 72 hours:
Customer Data Removal: Remove the list of WPEngine customers in the “domains.csv” file linked on wordpressenginetracker.com and hosted in the associated GitHub repository.
Restore Access to WordPress.org: Reinstate WPEngine’s and its related entities’ access to wordpress.org as it existed on September 20, 2024, including:- Reactivating and restoring login credentials for WPEngine employees to wordpress.org resources.
- Disabling technological blocks (e.g., IP address blocking) implemented around September 25, 2024.
- Restoring access to wordpress.org resources, including:
- Functionality and development tools (e.g., API, core.svn, plugins.svn, themes.svn, downloads, and translate resources).
- Data resources such as plugin, theme, and block directories.
- Security resources like login credentials.
- Support resources such as trac.wordpress.org and slack.wordpress.org.
- Removing the login checkbox added on October 8, 2024, requiring users to confirm they are not affiliated with WPEngine.
- Returning control of WPEngine’s Advanced Custom Fields (ACF) plugin directory listing.
Duration of Injunction
This preliminary injunction is effective immediately and will remain in effect until judgment is entered following the trial of this action.
